    *Elric looks at Orrick and shakes his head*

    1. So, you can only cast magic of the fourth circle. Do you know what circle the divine spell is that the defendant supposedly cast? Can you be sure that you know exactly what spell was supposedly cast and its apparent affects?

    2. You said that you could cast a glimmer so that it looked as if the defendant were casting a dark spell, is this so? And the other mage that thought he saw the same spell come from the defendant, that mage could have been fooled?

    3. You say you have never witnessed the particular spell the defendant supposedly cast; however, you are certain it caused Tifton's death? How can you be so sure through all the chaos of the night?

    4. You say that the dispel magics should have extended Tifton's life; however, you do not know that for a fact. Is it true that you really did not know what this would do? Is it not a fact that even the Abbot and Cadmus were unsure of what the dispel magics would do? That this was a "shot" in the dark, a last hope?

    5. You said you used a very high level dispel from a scroll? Now, I am an expert on using scrolls and can cast higher level magics than you, but I also know the problems inherent in using scrolls. One mis-word or inflection could cause disastrous affects. Is it possible that you miscast the dispel and this could have caused his death?

    6. You also say that it was easy to discern the defendant and were able to easily tell that he was casting something other than the dispells; however, Cadmus or the other participants, except the other unnamed individual that also says he witnessed it, DID NOT WITNESS THIS AURA. Why is that? Cadmus, a priest who should have been able to discern this spell better than you did not. Are you such a practiced mage that you can see everything around you, drink a cup of tea, read a treatise on rat catching in Neverwinter, and also read from a high level scroll without making a mistake?

    7. Is it not true that the other person that said he witnessed the defendant supposedly casting a spell other than dispel did not speak up until you did? He did not speak until you spoke. Is it not true also, that this person, Alyrian, is a WARLOCK! All of us that know of warlocks and their magic, know that their magic is from an evil source and inherently tainted. How do we know that this warlock did not speak up after you to cast blame on the defendant instead of himself. How do we know that the evil aura did not in fact come from the warlock himself?

    8. Last, how do we know the aura actually killed Tifton? Has there been a scrying or other means to find out what exactly killed Tifton? There could have been a number of things that went wrong.
    *Elric ticks them off*
    - The shards finally did their work and killed him
    - The dispells were too much for his weakend body and killed him
    - The Warlock could have used his tainted magic to kill him
    - The inherently tainted aspect of a Warlocks magic may have bonded with the shards and killed him
    - You could have cast a glimmer to make it seem the magic came from the defendant, instead of you or Alyrian
    - The children/demons could have penetrated the temple and caused his death

    In fact, is it not true that you do not know exactly what killed Tifton!

        "The witness has already stated that he witnessed Kemnebi cast the spell that led to Tifton's demise, not another member of the group that was gathered that night.

        "The witness is not confused, nor uncertain of the circumstances surrounding the events that transpired."
        "Master Elric merely wishes to paint a picture of uncertainty."

            * The judge nods *

            Sustained. Do not badger the witness, counselor Gallows. Keep your statements in the form of concise questions, and allow their testimony to be the center of this trial, not your own beliefs or grandstanding.

            The witness is simply testifying to being on hand during the death of Tifton Holyguard. However, since some degree of technical knowledge is required to comment on magic use, I will permit the defense to pose questions about the skill and qualifications of the witness.

              "Your honor, This is not grand standing nor badgering a witness. I asked specific questions based on his testimony?"

              "Please let him answer my questions if he can? Can we remind everyone that my client is still innocent unless proven guilty and that all we have so far is the testimony of two individuals, one of which is very questionable. Also, my question as to why he and he alone saw this happen is very pertinent to this case."

                Counselor, I have already said I will permit the defense to pose questions about the skill and qualifications of the witness. Do not make me repeat myself.

                Furthermore, it is not up to you to decide whether the witnesses testimony is or is not questionable, counselor. Leave it up to the jury to make up their minds. Any further improper conduct will lead to me finding you in contempt. Is this understood?

                Ask your questions, and move on. We do not need a dialog after every question. I am interested in hearing from the witnesses, counselor, not you.

                    2. I want to make sure of this, Orrick, can you or another, especially someone who can cast 9th circle magic, cast a glimmer that would fool you or others, a glimmer that could look like a spell being cast by someone else?

                    3. You say you have never witnessed the particular spell the defendant supposedly cast; however, you are certain it caused Tifton's death? How can you be so sure through all the chaos of the night?

                    4. You stated that the dispell magics cast on Tifton would save his life. Were you, Cadmus, and the Abbot sure of this or was there a possibility it could further harm him or at worst, do nothing to help him?

                    5. You said you used a very high level dispel from a scroll? What circle was it and if it was a very high circle, could you have miscast it, *Elric looks into Orrick's eyes* be honest?

                    6. You also say that it was easy to discern the defendant and you were able to easily tell that he was casting something other than the dispells. Can you answer why you were the only one to detect this aura and not Cadmus, who is a priest or the others involved. Of course, I would ask to discount what you say the other person said as heresay because we have not heard his testimony.

                    8. Last, how do you know the aura actually killed Tifton? Did you or anyone else scry or use other means to find out what exactly killed Tifton?

                        *Elric rises, looking exasperated*

                        Your honor, the questions go to the witnesses credibility and his state of mind before and during the ceremony with Tifton. If he knew or was told that the ceremony may not help him or even harm him, then we need to know that.

                        Also, we need to know why a 4th circle illusionist is suddenly an expert on divine magic when a divine spellcaster was indeed present and saw nothing!

                          Counselor Gallows, you're on thin ice as it is. At this point in the trial, we have had two witnesses; because no one else to this point has testified to seeing this aura or the actions of your client does not mean the current witness will be the only one.

                          You are leading the witness, and biasing the jury. You cannot ask the witness what others may have seen or felt during the time of the event. Furthermore, no divine spellcaster has yet testified, or been called to testify, so it is improper for you to mention "a divine spellcaster was indeed present and saw nothing." You are again commentating, and I will not stand for it in my courtroom. The jury will disregard your line of questioning.

                          Given your inabilty to follow the rules, we will move on to the presecution's next witness. One more offense, Mister Gallows, and you will be held in contempt, both fined and jailed.

                          Thank you, Mister Fole. You are dismissed.
