Spot checks generally have a -1 per 10 feet, so that could be a good rule of thumb. That way you get a -2 Spot vs a guy disguised 20 feet away from you.

Ugh. Disguise is a horribly explained skill in the book, but at least in PNP you have a DM for every single roll. Its so subjective and poorly explained as a skill, that I really don't like the idea of rolling on disguises at all, unless someone is actively impersonating someone else with wigs, makeup, etc. Thats the only time that disguise makes good sense to me, as a skill.
They have a mask? You certainly can't tell who they really are if you barely know them, and even if you do know them, the mask could obscure so much as to make identification impossible without speaking with them for a while (and then it makes no sense as a SPOT roll). That they are "disguised" is given.
And shapeshifted? I can't even figure out what the PHB means when it says 'if shapeshifting is used to make a disguise'. What does that even mean? If I can look like something else entirely, what is there to disguise? Your real face doesn't peel off, or that bear fur is real fur on a real bear, which happens to be a shapeshifted person.
Anyways, unless theres a DM or a player volunteering a disguise DC, I'd prefer roleplay not rollplay.
That of course, is just my opinion, but I don't feel that disguise is a skill that can be done right with a computer calculated number over your head.

my 2 cents on disguise as it pertains to what you're wearing.
i think that if you're wearing the exact same clothes/armor/weapon (ESPECIALLY if you have a unique item --- something not sold by merchants) and try to use disguise, it gives someone good reason to roll a spot roll. if you take the time and effort to change every aspect of your clothing/armor/weapons, I say that a spot roll shouldn't be automatic (unless you act funny or suspicious or have a full conversation with him/her).
This is of course a courtesy thing since it's a player vs player but I think most people on the server would/should roleplay that.characters:

The problem is people take rules that are designed for hard and fast number-crunching and try to apply them to life-like situations that are not always so neat and orderly.
It's really a DM call. Anytime I'm doing my PnP thing in the world as a DM, I allow people to take 20 for anything they're skilled at, meaning any skills they have ranks in (with the exception of magic, because I looooove to cause chaos with poor spell checks).
Then again, you can't please everybody, right? ^_^ Either way, it's not going to hurt my feelings when a decision is finally made regarding exactly what is permissable as "take 20" on a (of all things) disguise check.Active

As a player, I see no issue with other players using an alternate skill to one of the new ones. If Osclow wants to use perform for his disguise rolls, fine by me. I consider this a transition period really. Once we have a server wipe, this no longer becomes an issue.
