I think if you have ever tried LSD in your life, you are no longer legally sane. I think a police officer told me that once.

And I'll not be your movie hound for you Lollercide.. because honestly I gave you the only one I had...
Lately the only thing that keeps me from wishing for a worldwide disaster... is that it would probably interrupt my network connection

Kathryn Blake - In the time between times anything is possible. Kathryn's Theme Song
    (S)
Sasha Mursadus - Does that hurt? No?... let me try a little harder then... Sasha's Theme Song

Who is the person who will defend the defenseless?

To be legally insane you have to be a danger to yourself or others and I don't see how taking LSD at one point in your life would qualify you for that.
Of course: During a trip you may start to think you're a pixie and take a flying leap off a tall roof. Or you might stab your friends because you think that they're gargantuan s**t blobs trying to remove your spleen with a wooden spork.
But these effects are only temporary.

Though, LSD does stay in your spinal fluids for approximately 6 months so there is always the possibility that you might start to trip again just by cracking your back....

What was I going to say?... Oh, Right...

      Good luck with the move.

(P.S. Even though I'm legally sane and still trusted with sharp objects; the voices in my head which have convinced me that I am "Galzor, ruler of the undead" also compel me to believe that I lost what little I had left of my actual sanity long ago.)

      (P.P.S. ..... SpOrk.)

          Why thank you.

I actually spent three hours working on a banner like that just to have PSP crash on me and lose everything.

          But ces't la vie, right?

Need to revive this thread as after much brow beating, and no doubt physical intimidation from my husband ( namely he drove out there to "talk" with them ) the moving company will be here at 8 am sharp ( Mountain Time ) tomorrow morning and I'll be offline for at least a couple of days, I think that the internet company will be out on this upcoming friday to hook me up again, but I don't know for sure, so I'm not sure how long I'll be gone, hopefully no more than a couple of days ( busy days at least but my gut is wrenching at the idea of being away from you guys even that long ). Wish me luck and I hope all my fish live through the move

Theres actually several tests for holding a person to legally insane depending on the jurisdiction the basic ones are as follows:

M'Naughten Test: Whereby a defendant is legally insane if because of metal disease or defect the defendant was either unable to understand the nature and quality of his actions or was unable to know the wrongfulness of the action.

Irresistible Impulse: Defendant is entitled to acquittal only if because of mental illness the Defendant was unable to control his actions or conform his conduct to the law.

Durham (or New Hampshire) Test: Defendant is entitled to acquital if a crime was the product of his mental illness,

American Law Institute (Model Penal Code) Test: Defendant is entitled to acquittal if he had a mental disease or defect and as a result lacked the substantial capacity to either appreciate the criminaility of his conduct or conform his conduct to the requirements of the law.

Being a danger to yourself or others is a standard for civil commitment, not a test of legal insanity.

Well, I was simply referring to civil commitment - or more specifically - the requirements for a LEO to commit someone. I realize it's a lot more complicated when you start to get into issues of Mens rea and Actus reus but I wasn't so much trying to make a point about the insanity defense itself.

I'm not sure how a thread about me moving turned into a discussion of insanity.. but there is some sort of whimsical force in the universe that did this to me

My fault, I took a break from studying and read the forums; then saw the post on legal insanity and wanted to share with you some of the "fun" legal crap I was reviewing.
